If you are going to carry a gun, it’s important to know the laws at all times where you are with the gun. Due to negligence to gun laws, 27-year-old mother of two, Shaneen Allen of Philadelphia is facing (according to some sources) a potential 11.5 year prison sentence for carrying her licensed gun across state lines into New Jersey.
Allen was pulled over in New Jersey for a traffic violation. She immediately informed the police officer that she had a gun in the car for which she had a permit. She to the permit a week before. However, due to New Jersey’s laws, her Pennsylvania permit would not be honored. According to The Examiner, she was arrested, jailed for 40 days and now awaits serious prison time.
It would seem Allen, whose record is “squeaky clean,” would qualify for the state’d diversion program for first time defenders. Judge Michael Donio and District Attorney Jim McClain, the same ones who placed troubled NFL player, Ray Rice (who beat his present day wife unconscious) in the program, have refused Allen the privilege. According to The Washington Post:
The words common sense were mentioned quite a bit during Shaneen Allen’s hearing yesterday in Atlantic County Superior Court.
Allen, 27, cried for a moment in the hallway with her son Naiare and his father after a judge denied her motion to dismiss weapons charges filed against her in October and refused to overturn a prosecutor’s decision to deny her entry into a first-time-offender diversion program.
So Allen walked back into court, turned down a plea deal that would have given her a 3 1/2-year sentence and decided to go to trial in October, hoping a jury would use some common sense and not send a working mother of two to prison for not knowing New Jersey’s gun laws.
Law professor Glenn Harlan Reynolds feels they are trying to make an example out of her. He wrote, “The problem is she’s being punished for something the Constitution says — and the Supreme Court has agreed — is a constitutional right. And the super-stiff penalties and abusive prosecution she’s experiencing are pretty clearly intended to chill people from exercising that right.”
